These Terms of Service (“Terms”) govern your access to and use of On Ya Way Now Corp’s website at https://onyawaynow.com and our courier, logistics, and related services (“Services”). By using the Services, you agree to these Terms.

1) Accounts & Eligibility

You must be at least 18 years old and capable of forming a binding contract.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

2) Orders, Service Windows & Access

Pickup and delivery windows are estimates; unforeseen conditions (traffic, weather, access restrictions) may impact timing.
You must provide accurate pickup/drop‑off details and ensure lawful access and safe conditions.
We may refuse, cancel, or suspend orders that violate law, pose safety risks, or are otherwise prohibited.

3) Prohibited Items

We do not transport illegal goods, hazardous materials without proper documentation, weapons, or items prohibited by law or carrier policy. We reserve the right to inspect or decline items when permitted by law.

4) Fees, Payments & Refunds

Prices and fees will be disclosed at checkout, order confirmation, contract, or rate card.
Payments are processed securely by third‑party processors (e.g., Stripe). You authorize charges to the payment method you provide.
Late cancellations, wait time, re‑delivery, or additional handling may incur extra fees per our posted policy or contract terms.
Refunds, if any, are issued at our discretion in accordance with applicable law and our policies.

5) Risk of Loss; Title

Risk of loss passes to us upon receipt of items and returns to you or the recipient upon delivery or confirmed drop‑off per the selected service level and proof of delivery requirements.

6) Insurance & Limits of Liability

We maintain required business insurance. Supplemental shipment coverage may be available; ask for details before booking.
To the maximum extent permitted by law, our aggregate liability for any claim arising out of or relating to the Services is limited to the lesser of: (a) the amounts you paid for the specific service giving rise to the claim, or (b) USD $500, unless a written contract states otherwise.
We are not liable for indirect, incidental, special, or consequential damages.

7) Acceptable Use

You agree not to misuse the Services, interfere with operations, attempt unauthorized access, or submit harmful or unlawful content.

8) Intellectual Property

All content on the site, including trademarks, logos, and materials, is owned by On Ya Way Now Corp or our licensors and is protected by law. You may not use our IP without written permission.

9) Privacy

Your use of the Services is subject to our Privacy Policy. By using the Services, you consent to our data practices described there.

10) Termination

You agree to resolve disputes through good‑faith negotiations. If unresolved, the exclusive venue will be state or federal courts located in North Carolina.

We may update these Terms from time to time. Continued use after changes means you accept the updated Terms.
